ACH Rules. Company is responsible for complying with the rules as found within the ACH Rules mandated by NACHA and/or any changes and/or any updates to the ACH Rules mandated by NACHA. Bank shall not be responsible for fines that may be imposed if Company does not comply with the ACH Rules. All agreements and Rules apply to transactions while they are within the U.S. payment system. If Company is approved to send International ACH Transactions (“IAT”), Company agrees to originate entries in compliance with U.S. law, including, but not limited to, their obligations under programs administered by OFAC and Financial Crimes Enforcement Network (“FinCEN”) and in compliance of the payment system rules of the receiving country. Bank may delay transactions for greater scrutiny of transactions to comply with OFAC.

ACH Rules. All ACH funds transfers to and from your Account are subject to the requirements of ACH Rules, including without limitation provisions in the ACH Rules providing us authorization to initiate entries on your behalf and allowing us to audit your compliance with the ACH Rules and these ACH Terms and Conditions. You agree that it is your sole responsibility to familiarize yourself with the ACH Rules (as amended from time to time). You agree to give us complete and accurate information for any ACH funds transfer you request or authorize to or from your Account, as required by applicable law and ACH Rules. You also agree to make to us all representations and warranties that we are required to make, as the originating depository financial institution (ODFI), pursuant to ACH Rules and applicable law to the financial institution holding the deposit account to or from which you request or authorize an ACH funds transfer involving your Account. In connection with your election to make ACH payments to or from your Account through our secure online banking portal, you provide the following ACH authorization and agreement for all ACH transactions made to or from your Account ("ACH Authorization and Agreement”) and certify and agree as follows: (i) you are the owner of the External Account whose number(s) you have supplied and designated as a funding source for your Account and (ii) you authorize us to initiate credit or debit entries between your External Account and your Account from time to time until your Account is closed and no further credits or debits are authorized or permitted under this Agreement. You agree that the losses and damages covered by the “Indemnification” provision in the Agreement include without limitation fees, costs, and other expenses (including without limitation fines) we may be required to pay pursuant to ACH Rules and applicable law in connection with ACH funds transfers you request or authorize that do not comply fully with applicable law and ACH Rules.
ACH Rules. The Originator acknowledges receipt of a copy or has access to a copy of the Rules. The Originator agrees to comply with and be bound by the Rules. In the event the Originator violates any of the applicable Rules and NACHA imposes a fine on the Financial Institution because of the Originator's violation, the Financial Institution may charge the fine to the Originator. The Financial Institution agrees to inform the Originator of revisions to the Rules of which the Financial Institution has knowledge.
ACH Rules. All Transfers initiated hereunder are subject to the Operating Rules and Guidelines of NACHA – The Electronic Payments Association (“NACHA”) and applicable regional or local ACH (“NACHA Rules”). All credits to your Accounts or External Accounts shall be provisional until we or such other financial institution that holds your External Accounts finally pays and settles for any such credit. If, for any reason, final settlement or credit is not received, your Accounts or External Accounts may be charged back for the amount(s) thereof, together with any applicable fees or charges. Additionally, illegal transactions, such as online gambling, will be blocked when detected by NACHA and/or the Bank. You agree to comply with and to be bound by the Rules, NACHA Rules and related procedures, as well as to the terms and conditions of this Addendum. External Transfers To use the Money HQ Service for “External Transfer,” you must maintain at least one deposit Account with us and at least one External Account, between which you may Transfer funds. Standard Transfer withdrawals affecting your Accounts are executed through ACH entries from or to linked External Accounts. You may originate withdrawals or deposits through the Money HQ Service from or to your Accounts, in a standard processing aggregate dollar amount limited to $2,000 per transaction (completed), and $5,000 per rolling 30-day period. NOTE: Higher limits are enabled for standard processing under the following conditions: When the End-User (1) has established the Service for 3 months, (2) has had no negative activity or insufficient funds returns for Transfers, and (3) has completed at least one $1,000 Transfer over 60 days in the past. The higher limits for standard processing inbound and outbound shall be $15,000 per day, and $25,000 per rolling 30-day period.
ACH Rules. The terms of this Agreement are subject to the ACH Rules. Unless otherwise defined, capitalized terms used in this Section 28 have the meanings provided in the ACH Rules. The term "Entry" is defined as provided in the ACH Rules and also includes an entry for credit or debit to an account maintained with Bank ("On-Us Entries") and a Prenotification.

ACH Rules. The Customer has access to a copy of the Rules, acknowledges receipt of a copy, or may purchase a copy if they so desire. The Customer agrees to comply with and be bound by the Rules. In the event the Customer violates any of the applicable Rules and NACHA imposes a fine on the Bank because of the Customer’s violation, the Bank may charge the fine to the Customer. The Bank agrees to inform the Customer of revisions to the Rules of which the Bank has knowledge.

ACH Rules. Company agrees to comply with and be bound by the current Rules in existence which may be amended from time to time. The duties of Company set forth in this Agreement in no way limits the requirements of complying with the Rules. Any fines or liabilities imposed against Financial Institution for a violation of the Rules caused by an action and/or inaction of Company may be assessed against Company. Costs associated with Rules publications and/or association membership will be the responsibility of Company. If Company utilizes third-party vendor or processor, Company will take such measures as may be necessary to ensure compliance with the Rules by such vendors and processors.
