Access and Use Restrictions. Customer shall not (directly or indirectly): (a) copy or reproduce the SaaS Products or the Documentation except as permitted under this Agreement; (b) exceed the subscribed quantities, users or other entitlement measures of the SaaS Products as set forth in the applicable Order; (c) remove or destroy any copyright, trademark or other proprietary marking or legends placed on or contained in the SaaS Products, Documentation or CyberArk Intellectual Property; (d) assign, sell, resell, sublicense, rent, lease, time-share, distribute or otherwise transfer the rights granted to Customer under this Agreement to any third party except as expressly set forth herein; (e) modify, reverse engineer or disassemble the SaaS Products; (f) except to the limited extent applicable laws specifically prohibit such restriction, decompile, attempt to derive the source code or underlying ideas or algorithms of any part of the SaaS Products, attempt to recreate the SaaS Products or use the SaaS Products for any competitive purpose; (g) create, translate or otherwise prepare derivative works based upon the SaaS Products, Documentation or CyberArk Intellectual Property; (h) interfere with or disrupt the integrity or performance of the SaaS Products; (i) attempt to gain unauthorized access to the SaaS Products or its related systems or networks, or perform unauthorized penetrating testing on the SaaS Products; (j) use the SaaS Products to infringe on the Intellectual Property rights, publicity rights, or privacy rights of any third party, or to store or transfer defamatory, trade libelous or otherwise unlawful data; or (k) send, store or process in the SaaS Products any personal health data, credit card data, personal financial data or other such sensitive regulated data not required by the Documentation, or any Customer Data that is subject to the International Traffic in Arms Regulations maintained by the United States Department of State. Customer’s authorized use of the SaaS Products is subject to the purchased quantities and features set forth in the applicable Order for the SaaS Products. Fees for the SaaS Products are based on use of the SaaS Products in a manner consistent with the Documentation. If Customer uses the SaaS products in a manner that is outside or in violation of the Documentation, then Customer will cooperate with CyberArk to address any applicable burden on the SaaS Products or pay an additional mutually agreed upon fee.

(d) Subscriber may not (and may not permit others to) bypass or disable any protections that may be put in place against unlicensed use of TrackWise Digital, or use or access TrackWise Digital or any Consulting Services or any Confidential Information of Sparta or third-parties in any way that might adversely affect the security, stability, performance or functions of TrackWise Digital, including by introducing any malware into TrackWise Digital or any part of TrackWise Digital. (e) Subscriber may not (and may not permit others to) use the Org that is provisioned by Sparta for any purpose other than exclusively using TrackWise Digital, and may not increase the number of custom objects within the Org other than those included in TrackWise Digital. (f) Subscriber may not (and may not permit others to) access, distribute or use any customer relationship management functionality of the SFDC Service.

Access and Use Restrictions. The User shall comply with all applicable laws, including export control and data privacy laws. The User shall not: (i) execute or attempt to execute any malware in the Software or use or attempt to use the Software to transmit malware; (ii) use the Software to store or distribute any information, material or data that is harassing, threatening, infringing, libelous, unlawful, obscene, or which violates the rights of any third party; (iii) access or use the Software to compete against Camunda or to build a competitive product or service; (iv) use the Software for purposes of monitoring performance or functionality (for example via penetration testing) or for any other benchmarking or competitive purposes, including, without limitation, for the purpose of designing and/or developing any competitive services; (v) except as expressly permitted herein, provide access to the Software by making User’s Trial Account available to any third party;

Customer shall not disclose the results of any benchmark tests run on the Platform, without the prior written approval of Company.
Access and Use Restrictions. Except for the rights expressly granted herein, Redwood does not grant, license, nor transfer to Client or any other third party any ownership or right to any Redwood Products or Redwood intellectual property. No implied licenses are granted herein, and all rights not expressly granted to Client herein are reserved by Redwood, its Affiliates, and their respective suppliers or licensors where applicable. Client shall not: 2.2.1. except to the extent permitted by applicable law: (i) disassemble, reverse engineer, nor decompile the Redwood Products or any portion thereof; (ii) copy, distribute, reseller, modify, rent, lease, sell, or otherwise use the Redwood Products for the benefit of anyone other than the Client; (iii) access or use Redwood Products to create a competing product; or (iv) perform or disclose any benchmark tests relating to Redwood Products; 2.2.2. scrape, spider, or utilize other automated means of any kind to access the Redwood Products, including, but not limited to, accessing API endpoints for which Client or its Authorized Users have not been provided authorization by ▇▇▇▇▇▇▇; 2.2.3. modify, remove, or obstruct any proprietary rights statement or notice contained in the Redwood Products; 2.2.4. modify, remove, or obstruct any proprietary rights statement or notice contained in the Redwood Products; violate the security of Redwood Products, including attempting to test the security or vulnerability thereof, or breach any security or authentication measures; (ii) bypass or disable any protections that may be put in place against unlicensed use of Redwood Products, or actually or effectively circumvent any contractual usage; or (iii) use or access Redwood Products in any way that might disrupt the integrity of or adversely affect the security, stability, performance or functions of Redwood Products; or 2.2.5. (i) use Redwood Products to store or transmit unlawful, fraudulent, infringing, or otherwise unlawful or tortious material, including material that is harmful to children or that violates third-party rights; (ii) upload to or use Redwood Products to store or transmit viruses, worms, time bombs, Trojan horses or other harmful or malicious code, files, scripts; or (iii) use Redwood Products in any way that disrupts the overall performance of the Redwood Products.
