Returning to work after a period of parental leave An employee will notify his/her intention to return to work after a period of parental leave at least four weeks prior to the expiration of the leave. An employee will return to the position, which he/she held immediately before proceeding on parental leave. In the case of an employee transferred to a safe job pursuant to 28.8, the employee will return to the position he/she held immediately before such transfer. Where such position no longer exists but there are other positions available which the employee is qualified for and is capable of performing, the employee will return to a position as nearly comparable in status and pay to that of his/her former position. Replacement employees A replacement employee is an employee specifically engaged or temporarily promoted to or transferred as a result of another employee proceeding on parental leave. Before an employer engages a replacement employee the employer must inform the person of the temporary nature of the employment and of the rights of the employee who is being replaced.

An employee will be entitled to the position that they held immediately before proceeding on parental leave. In the case of an employee transferred to a safe job pursuant to clause S.10.4.5, the employee will be entitled to return to the position they held immediately before such transfer. Where such position no longer exists but there are other positions available which the employee is qualified for and can perform, the employee will be entitled to a position as nearly comparable in status and pay to that of their former position. Where an employee requests to return to work on reduced hours, such request will not be unreasonably refused. After a period of parental leave, an employee may request to return to work on reduced hours until the childreachesschool age. The employershall make allreasonable attempts to facilitate the request, but may refuse such request on reasonable business grounds

A pilot will be entitled to the position, which they held immediately before proceeding on parental leave. In the case of a pilot transferred to a safe job pursuant to 2.14.3, the pilot will be entitled to return to the position they held immediately before such transfer. Where such position no longer exists but there are other positions available, which the pilot is qualified for and is capable of performing, the pilot will be entitled to a position as nearly comparable in status and pay to that of their former position.
