AUTOMATED TELLER MACHINE. During the period Tenant occupies any space on the ground floor of the Building for the operation of a retail banking business pursuant to Article 30 or otherwise, Tenant shall have the right to install an Automated Teller Machine (“ATM”) in the main lobby of the Building or near the entrance of the Building at a location mutually acceptable to Landlord and Tenant, subject to the terms and conditions contained herein. Prior to installation of the ATM, Tenant shall provide Landlord, for Landlord’s approval, with a complete set of plans and specifications for the proposed ATM. Tenant shall pay all fees and costs incurred by Landlord in the evaluation of such plans and specifications. Installation of the ATM shall be made at Tenant’s sole costs and expense and shall be done in a good and workmanlike manner and diligently prosecuted to completion. Before commencing any work, Tenant shall give Landlord at least ten (10) days’ written notice of the proposed commencement of such work in order to give Landlord an opportunity to prepare, post and record such notice as may be permitted by law to protect Landlord from having its interest in the Premises or the Building made subject to any mechanic’s or materialman’s lien. Tenant shall provide its own trash container or contains for construction debris; shall promptly remove all construction and related debris from all public and common areas; immediately following completion of construction shall return the public and common areas to the condition they were in immediately prior to construction; shall repair and restore any portions of the public and common areas harmed as a result of the construction activities to the condition they were in immediately prior to construction; shall use service entrances to the Premises, if any; shall conduct no core drilling during business hours; shall disrupt other tenants as little as possible; shall perform such work or cause the performance of such work in such a manner as shall not obstruct access to the Project or the premises of any other tenant other then tenant within the Project; shall pay to Landlord the amount of any and all damage to the Project; and shall otherwise comply with all conditions imposed by Landlord with respect to such connection with any such work, and such work shall be performed in accordance with all applicable laws and ordinances. AUTOMATED TELLER MACHINE. “ATM”) Services You understand that you may use your ATM Card and/or Visa® Debit Card (“Card(s)”) at an ATM to: (1) withdraw cash from your accounts; (2) make or arrange for a deposit to your accounts; (3) effect transfers to or from your accounts; (4) receive information regarding the balance of your account(s); (5) change the Personal Identification Number (“PIN”) number applicable to your Card; and, (6) perform such other transactions as we may expressly authorize. You understand that you may also make certain payments only at ATMs that are built into or are inside our branches. You may deliver cash, checks, drafts and similar items at ATM locations which accept deposits for transmission to us for deposit into your accounts. Not all ATMs, however, accept deposits. Some ATMs that do accept deposits may only provide access to the account(s) that you have designated as your primary checking and/or savings account. You may also use ATMs throughout the United States bearing the STARSM or PLUS® system name logo and in certain foreign countries which bear the PLUS® system name logo to: (1) make withdrawals from, (2) effect transfers to or from, or (3) receive information regarding the balance in your checking or savings account(s) designated as the primary account of such type on your application form. There may be some limitations on transactions available at ATMs in foreign countries. We may change the ATM networks we make available to you at any time. You will receive advance notice of any such change. These terms and conditions apply to all Cards we issued to you and all transactions for which you use a Card. In consideration of us issuing you a Card, you agree to be legally bound by the terms and conditions of this Agreement, as it may be amended from time to time.
AUTOMATED TELLER MACHINE. Tenant shall have the right to install one (1) ATM and night depository in the Premises (collectively referred to herein as (“ATM”). The location, plans and specifications for the ATM (including the identifying signage) shall be subject to the prior written approval of Landlord and are affixed hereto as Exhibit G. Tenant shall be solely responsible for the cost of installation of the ATM, together with all maintenance and repairs of the ATM and related equipment, cables and conduits. Tenant shall also be responsible for all security pertaining to the ATM, and shall operate same in accordance with all applicable laws and regulations. Tenant shall ensure that the ATM remains properly lighted during evening hours utilizing lighting fixtures approved by Landlord. Tenant shall indemnify, defend and hold Landlord harmless from any liability, loss or expense resulting from the operation of the ATM in accordance with the provisions of Section 10.3 of the Lease. Any alterations to the ATM shall be subject to Landlord’s prior written approval and the provisions of Section 7.3 of this Lease. Promptly following the termination of this Lease, Tenant shall remove the ATM and restore the affected area of the Building to its pre-existing condition, wear and tear excepted.
AUTOMATED TELLER MACHINE. (ATM) Deposits. When you make a deposit in an ATM, funds from deposit of US Treasury checks that are payable to you and checks drawn on GTE Financial will be available on the first business day after the day of your deposit. For other check deposits made at a GTE Financial ATM, the first $225 of the deposit will be available by the next business day with the balance of the ATM deposit fully available no later than the second business day after the deposit is made. If you make a deposit at an ATM that we own or operate before 6:30 p.m. on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit at an ATM that we own or operate after 6:30 p.m. or on a day we are not open, we will consider that the deposit was made on the next business day we are open. For deposits made at an ATM not operated by GTE Financial, the balance of the ATM deposit will be fully available no later than the fifth business day after the deposit is made. For determining the availability of your ATM deposits, every day is a business day except Saturdays, Sundays, and federal holidays. GTE ATMs, and other ATMs in the Co-Op Network, can be identified by the GTE logo as well as by information regarding a GTE fee notice and funds availability standards. Images of the GTE ATMs may also be viewed by visiting xxx.xx-xxxx.xxx/Xxxxxx-Xxxxxxxx-XXXx. GTE proprietary ATMs can be found at GTE Community Financial Centers, which you can find at xxx.xxxxxxxxxxxx.xxx/xxxxxxxxx. GTE will not charge you for use of an in-network ATM to withdraw funds from your account. You agree to pay all ATM transaction fees as outlined in the Fee Schedule, GTE will charge you per occurrence (each time you make a withdrawal) for withdrawals conducted at a non-network ATM. See fee Schedule for the exact fee amount. This fee is in addition to any fees the non-network ATM operator may charge for such transactions. GTE also charges you each time you conduct an account balance inquiry online or at a non-network ATM machine. You understand and agree that We will charge you a fee for each balance inquiry made at an out-of-network ATM and a separate fee for each Cash Withdrawal or Transfer made at an out-of-network ATM, even if the balance inquiry and withdrawal or transfer are made during the same visit.
