The Yield Rate applicable to any Portion of Capital shall be increased by 2.00% per annum.
The Capital of each Purchaser shall accrue interest on each day when such Capital remains outstanding at the then-applicable Yield Rate for such Capital.
Any such Portion of Capital (which may be all) for which such an election has been made shall be apportioned among the Purchasers ratably based on each Purchaser’s respective Portion of Capital for which the Yield Rate is the Bank Rate.
For the avoidance of doubt, if an Event of Default is then continuing, the Yield Rate for any Capital shall be determinedin the event of any conflict between the Seller’s election pursuant to this clause (i) and rate of interest applied pursuant to the definition of “Yield Rate notwithstanding any otherwise applicable election by the Seller,” the definition of “Yield Rate” shall control.
Each Group Agent shall record in its records, the date and amount of each Investment made by the Purchasers in its Group hereunder, the Yield Rate with respect to the related Capital (and each portion thereof), the Yield accrued thereon and each repayment and payment thereof.
