Except for Confidential Information that the Contracting Parties have identified in writing to Hospital as being commercially sensitive, in which case the obligations of Section 5.1 to Section 5.5 inclusive shall continue, the obligations in Section 5.1 to Section 5.5, inclusive, will cease on the date that is three (3) years after the Total Completion of the Project.

Thirty days before the date by when Total Completion is required to occur according to clause 2.01(b), the Recipient must provide MHRC with an unaudited statement of the Actual Project Costs incurred to that date, and the Estimated Project Costs still to be incurred, up to Total Completion.
Contractor Delay means any delay in achieving Substantial Performance of the Work or Total Completion by the prescribed dates set out in paragraph 1.3 of Article A-1 of the Agreement – THE WORK other than as expressly permitted under GC 6.5 – DELAYS.
