Examples of TIA in a sentence
If, for any reason, Wilmington Trust or any of its Affiliates should assume the duties of the Indenture Trustee, then from that time forward Wilmington Trust, in its capacity as Owner Trustee, shall resign as Owner Trustee hereunder if any Event of Default under the Indenture occurs and is necessary to eliminate any conflict of interest under the TIA with the Indenture Trustee or any other trustee under the Indenture.
If and when the Trustee shall be or become a creditor of the Issuer or the Parent Guarantor (or any other obligor upon the Notes), excluding any creditor relationship listed in TIA Section 311(b), the Trustee shall be subject to the provisions of the TIA regarding the collection of the claims against the Issuer or the Parent Guarantor (or any such other obligor).
To the extent this Indenture has been qualified under the TIA, (a) the Trustee shall comply with TIA § 311(a), excluding any creditor relationship listed in TIA § 311(b), and (b) Trustee who has resigned or been removed shall be subject to TIA § 311(a) to the extent indicated therein.
This Indenture shall always have a Trustee who satisfies the requirements of TIA § 310(a)(1).
Securityholders may communicate pursuant to TIA § 312(b) with other Securityholders with respect to their rights under this Indenture or the Securities.
