The Parties shall not be bound by or liable for any documents proposed or submitted prior to the Third Restatement Date and not incorporated into (by reference or otherwise) or referred to in this Agreement, or by or for any statement, representation, promise, inducement or understanding of any kind or nature relating to the Work or any other matter covered by this Agreement which is not set forth or provided for herein.
Owner shall make payment of the Contractor’s Margin Catch-up Payment in six (6) equal consecutive monthly instalments commencing in the month immediately following the month in which the Third Restatement Date occurs.
