Third Lien Documents definition

Third Lien Documents means the Initial Third Lien Documents, the Additional Third Lien Documents and all other loan documents, notes, guarantees, instruments and agreements governing or evidencing any Third Lien Substitute Facility.

Third Lien Documents means, collectively, the Note Documents, any other agreement pursuant to which any Third Lien Debt is incurred and the Third Lien Security Documents.

Third Lien Documents means the Third Lien Agreement, any notes issued pursuant thereto, and any indentures, credit, guarantee, intercreditor and security documents governing the Third Lien Obligations and all other documents, instruments and agreements executed pursuant to any of the foregoing.

• Each party hereto hereby acknowledges and agrees that each of the Priority Lien Agent, the Second Lien Collateral Trustee and the Third Lien Collateral Trustee is entering into this Agreement solely in its capacity under the Priority Lien Documents, the Second Lien Documents and the Third Lien Documents, respectively, and not in its individual capacity.

• The First Lien Creditors agree not to initiate or prosecute or join with any person to initiate or prosecute any claim, action or other proceeding challenging the enforceability, validity, priority or perfected status of any Liens on assets securing the Second Lien Obligations under the Second Lien Documents or the Third Lien Obligations under the Third Lien Documents.

• A Master Agreement Default shall not constitute or trigger a Default or Event of Default under (and as defined in) any of the Credit Agreements or the Third Lien Documents unless and until the Second Lien Agent exercises its right under the Lockup Remedies to accelerate the Second Lien Loans after any applicable notice and cure period described in this Section 10 have lapsed.

More Definitions of Third Lien Documents

Third Lien Documents means, collectively, the Note Documents and any indenture, credit agreement or other agreement or instrument governing the Third Lien Debt and the Security Documents (other than any Security Documents that do not secure Third Lien Obligations).

Third Lien Documents means the Convertible Third Lien Notes, the Third Lien Note Purchase Agreement and all other “Credit Documents” as defined in the Third Lien Note Purchase Agreement.

Third Lien Documents means, collectively, the Third Lien Indenture, the Third Lien Notes and the Third Lien Security Documents (other than any security documents that do not secure Third Lien Obligations).

Third Lien Documents means the Third Lien Collateral Documents, and the letter agreements evidencing the Extended Prepetition Debt entered into by the Borrower and the holder of such Extended Prepetition Debt.

Third Lien Documents the Credit Agreement, all Loan Documents (as such term is defined in the Third Lien Credit Agreement) and all other agreements, documents and instruments at any time executed and/or delivered by any Obligor or any other Person with, to or in favor of the Third Lien Trustee or any Third Lien Creditor in connection therewith or related thereto, including such documents evidencing successive Refinancings of the Third Lien Obligations, in each case, as amended, amended and restated, supplemented, modified, replaced, substituted or renewed from time to time in accordance with the terms of this Agreement.

Third Lien Documents means, collectively (without duplication), each Third Lien Loan Document, the Third Lien Collateral Documents and any other agreement, document or instrument providing for or evidencing the Third Lien Obligations, in each case as such may be amended or, in the case of the Third Lien Credit Agreement, as Amended and Refinanced.
