Any such extension or waiver shall be valid only if set forth in an instrument in writing signed by the Party or Parties to be bound thereby.
All notices, demands, and other communications under this Agreement, shall be in writing and shall be deemed to have been duly given on the date of service if served personally on the Party to whom notice is to be given or to a person found at the same address of suitable age and discretion or with five (5) days if mailed to the Party for whom notice is to be given, by registered mail, first class mail, or by courier service.
A regular or alternate Director shall serve at the pleasure of the governing body of the Party that the regular or alternate Director represents and may be removed by such governing body at any time, with or without cause.
Any waiver of a breach of this Agreement must be in writing signed by the Party granting the waiver.
However, the Party affected shall use all reasonable endeavours to limit the amount of non- performance or delay in performance of its obligations hereunder.
