Testing Party has the meaning set forth in Section 1.5.

Testing Party means the firm (including, but not limited to, domestic manufacturers, foreign manufacturers, importers, private labelers, third party conformity assessment bodies, or component part suppliers) who tests a consumer product, or any component part thereof, for compliance, in whole or in part, with any applicable rule, ban, standard, or regulation enforced by the CPSC.

Testing Party means a party (in- cluding, but not limited to, domestic manufacturers, foreign manufacturers, importers, private labelers, or compo- nent part suppliers) who procures tests (either by conducting the tests them- selves, when this is allowed, or by ar- ranging for another party to conduct the tests), of a consumer product, or any component part thereof, for com- pliance, in whole or in part, with any applicable rule, ban, standard, or regu- lation enforced by the CPSC. Testing laboratories and third party con- formity assessment bodies are not test- ing parties under this definition.

Testing Party means the Party conducting a test.

Testing Party means (a) so long as Parent is not a Borrower pursuant to Section 9.15, TWE and (b) at any time after Parent becomes a Borrower pursuant to Section 9.15, Parent.
