Test Product definition
Test Product means a Macrolide Antibiotic or derivative or analog thereof that has been designated by Cempra to be the subject of Development pursuant to Section 3.4.
Test Product means a composition for use in the Field, which if made, used or sold would infringe one or more Valid Patent Claims of a Licensed Patent, but for the license granted by this Agreement, or which otherwise uses or incorporates Licensed Know-How.
Test Product means a kit containing reagents and any materials, information and / or equipment necessary to perform all or part of the Tests, to the extent the parties mutually agree to commercialize such a kit in the Territory as described in clause 2.3, and “Test Products” shall be construed accordingly.
Examples of Test Product in a sentence
Company will have the right to use the Test Product for a period as agreed with Trend Micro, during which period Company may use the Test Product solely for Company’s internal evaluation in a non- production environment (i.e. an environment absent of any live production Company Data or otherwise perform productive work) for the sole purpose of deciding whether to purchase the right to continue to use the Product.
Company acknowledges that the Test Product are provided to company “AS IS”, “WITH ALL FAULTS”, “AS AVAILABLE” without warranty of any kind (express, implied, or otherwise).
