The Tenant's scope of use includes the leased floor of the building and all related public facilities.
In performing its duties and obligations hereunder, the City may rely upon statements and certificates of the Owner and the Very Low Income Tenants, and upon audits of the books and records of the Owner pertaining to the Project.
Except as otherwise set forth in Section 5(l) below with respect to Existing Tenants, Owner shall market all Very Low Income Units and select Tenants for ongoing renting of the Very Low Income Units all in compliance with the requirements set forth in the Administrative Plan, the RAD Tenant Selection Plan (defined below), and the income and rent restrictions set forth in this Regulatory Agreement.

The City, the Fiscal Agent and the Owner hereby further declare their understanding and intent that the benefit of such covenants touch and concern the land by enhancing and increasing the enjoyment and use of the Project by Very Low Income Tenants, the intended beneficiaries of such covenants, reservations and restrictions, and by furthering the public purposes for which the Note was executed and delivered.
