This Memorandum of Agreement (“MOA”) is entered into as of this 05 day of April , 20 23 , between Union Pacific Railroad, (hereinafter “UPRR”) and the United States Army Corps of Engineers (hereinafter “Corps”), Sacramento District (hereinafter “SPK”), Albuquerque District (hereinafter “SPA”), Los Angeles District (hereinafter "SPL"), and San Francisco District (hereinafter "SPN”) (hereinafter individually referred to as the “Corps District” and collectively as “Corps Districts”).
To provide for consistent and effective communication, SPK, on behalf of itself and SPA, SPL, and SPN, and UPRR, each will appoint a Principal Representative to serve as its central point of contact on matters relating to this MOA.
Symantec will register a Device that conforms to the SPL by the later of: (i) the Start Date identified on the initial page(s)of the Certificate, (ii) the mutually agreed upon Device Registration date (if applicable), or (iii)fifteen (15) business days following Symantec’s receipt of all reasonably requested technical and license information for each Device, as further specified in the Certificate.
Additional representatives may also be appointed to serve as points of contact for SPK, SPA, SPL (as applicable), and/or SPN on specific Section 404 or Section 10 permit applications and/or Section 408 requests.
Prior to SPK dispersing any funds to SPL for review of UPRR-designated priority projects that require Section 404 and/or Section 10 authorization from SPL, UPRR and SPL would first develop a mutually agreeable budget estimate, including identification of personnel, hourly rates, indirect labor costs, estimated hours of work, and travel costs related to the MOA scope of work, as required by SPL policy.
