Specially Written Software definition

Specially Written Software means any software (including database software, linking instructions, test scripts, compilation instructions and test instructions) created by the Supplier (or by a Sub-Contractor or other third party on behalf of the Supplier) specifically for the purposes of this Contract, including any modifications, configuration, customisation, or enhancements to Supplier Software or Third Party Software created specifically for the purposes of this Contract;
Specially Written Software means any software created by the Contractor (or by a third party on behalf of the Contractor) specifically for the purposes of this Contract.
Specially Written Software means any software created by the SERVICE PROVIDER (or by a third party on behalf of the SERVICE PROVIDER, including by any Sub-Contractor) specifically for the purposes of this Contract.

Examples of Specially Written Software in a sentence

  • Where a patent owned by the Supplier is necessarily infringed by the use of the Specially Written Software or Project Specific IPRs by the Authority or any Replacement Supplier, the Supplier hereby grants to the Authority and the Replacement Supplier a non-exclusive, irrevocable, royalty-free, worldwide patent licence to use the infringing methods, materials or software solely for the purpose for which they were delivered under this Contract.

  • If a licence granted in Clause 17.1 (Specially Written Software and Project Specific IPRs) ) is novated under Clause 17.8 (Authority’s right to assign/novate licences) or there is a change of the Authority’s status pursuant to Clause 17.9, the rights acquired on that novation or change of status shall not extend beyond those previously enjoyed by the Authority.


More Definitions of Specially Written Software

Specially Written Software means any software created by the Supplier (or by a third party on behalf of the Supplier, including by any Sub-Contractor) specifically for the purposes of this Contract and shall consist of any programs, codes and software written by or on behalf of the Supplier for use by the Supplier specifically in the provision of the Services (including any modifications or enhancements made to such software during the Contract Period);
Specially Written Software any software (including database software, linking instructions, test scripts, compilation instructions and test instructions) created by the Supplier (or by a Sub-contractor or other third party on behalf of the Supplier) specifically for the purposes of this Agreement, including any modifications or enhancements to Supplier Software or Third Party Software created specifically for the purposes of this Agreement.
