Spare Capacity definition

Spare Capacity means any Poles, Conduit, Duct or Inner-Duct not currently assigned or subject to a pending Application for Attachment/Occupancy. Spare Capacity does not include an Inner-Duct (not to exceed one Inner- Duct per party) reserved by AT&T-22STATE, CLEC, or a Third Party for maintenance, repair, or emergency restoration.
Spare Capacity means the capacity, from time to time, of the network, as configured at the time of an application, to provide the covered services sought in the application, having regard to Western Power’s contractual obligations in respect of the network.
Spare Capacity has the meaning given in the Port Terminal Rules.
