Settlement Subclass definition

Settlement Subclass means any member of the Settlement Class who had their Social Security number, driver’s license, and/or financial information (credit and/or bank account information) potentially compromised in the Incident.
Settlement Subclass means all Subclass Members who do not timely and validly exclude themselves from the Class pursuant to the procedure set forth in Section IX of this Settlement Agreement.
Settlement Subclass or “Subclasses” means the following (a) a “Physician” Subclass, (b) a Nurse Subclass, and (c) a Technician Subclass. These are defined as:

  • The Court further finds that the proposed Settlement and Notice Plan meet the requirements of Rule 23(e) and that the Court will likely be able to certify the Settlement Class and California Settlement Subclass for purposes of judgment on the Settlement.

  • The Court preliminarily certifies for settlement purposes the following Contact Sport Settlement Subclass pursuant to Federal Rules of Civil Procedure 23(b)(2): All Persons who played an NCAA-sanctioned Contact Sport at an NCAA member institution on or prior to the date of this Order.

  • If the Claims Administrator should receive an incomplete Claim Form or a Claim Form with insufficient documentation to determine whether the claimant is a Settlement Class Member or, if applicable, a California Settlement Subclass member, the Claims Administrator shall request additional information and give the claimant twenty-one (21) days to cure any defect(s) before rejecting a settlement claim.

  • The Court further hereby certifies, for settlement purposes only, a California Settlement Subclass consisting of: members of the Settlement Class that were residents of the State of California on August 1, 2021.

  • To redeem this additional benefit, California Settlement Subclass Members must submit a Settlement Claim and attest that they were a California resident at the time of the Data Incident(s) about which they were notified by Defendant.


More Definitions of Settlement Subclass

Settlement Subclass means all individuals whose Social Security, financial account, bank account, and/or driver’s license numbers may have been accessed in the Data Incident announced by DCA in or after October 2020.
Settlement Subclass means “all persons Preferred Home identified as being among those individuals potentially impacted by the Data Incident, who were further identified as being among those whose Social Security Numbers were potentially compromised, and who were sent a notice of the Data Incident.”
Settlement Subclass means all Subclass Members who do not timely and validly exclude themselves from the Class pursuant to the procedure set forth in Section IX of
Settlement Subclass or “California Subclass” means all persons identified by Defendant (or its agents or affiliates) as being individuals residing in California impacted by the Data Incident, including all who were sent a notice of the Data Incident. The Settlement Subclass specifically excludes: (i) Defendant and its respective officers and directors; (ii) the Judge(s) to whom the action is assigned and any member of those Judges’ staffs or immediate family members; and (iii) any other Person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Data Incident or who pleads nolo contendere to any such charge.
Settlement Subclass means all members of the Class who purchased MicroStrategy common stock contemporaneously with sales of MicroStrategy common stock by any of the Individual Defendants, that is on one or more of the following dates: July 26, 27, 28 or 29, 1999, August 16, 17 or 18, 1999, October 21, 22, 25, 26, 27, 28, or 29, 1999, November 1, 18,
Settlement Subclass means any member of the Settlement Class who had their medical information protected by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and other protected health information potentially compromised as a result of the cyberattack that MedStar discovered in or about October 2022.
Settlement Subclass means all members of the Class who purchased MicroStrategy common stock contemporaneously with sales of MicroStrategy common stock by any of the Individual Defendants, that is on one or more of the following dates: July 26, 27, 28 or 29, 1999, August 16, 17 or 18, 1999, October 21, 22, 25, 26, 27, 28, or 29, 1999, November 1, 18, 19, or 22, 1999, February 28 or 29, 2000 or March 1, 2000. The definition of the Settlement Subclass represents a modification of the Certified Subclass defined in the Amended Stipulation and Agreement Regarding Class Certification, entered into by the Parties on or about August 10, 2000, and subsequently approved by the Court, as amended, on August 25, 2000. The Settling Parties will request the Court to certify the Settlement Subclass, as modified from the Court's prior Order, solely for the purposes of the Settlement contemplated herein. Anyone excluded from the Class is also excluded from the Settlement Subclass.
