The Trust Fund was created, and the Mortgage Loans (other than the Outside Serviced Mortgage Loans) are to be serviced, pursuant to the Pooling and Servicing Agreement (as defined below).

As applicable, each Purchaser and its Affiliates shall at all times maintain all necessary Permits in order to be qualified to act hereunder as a Servicer and perform and discharge all Serviced Duties consistent with the terms hereof.
