Senior Secured Note Documents definition

Senior Secured Note Documents means the Senior Secured Note Indenture, the Senior Secured Note Guarantees, the Senior Secured Notes, the Intercreditor Arrangements, any security document relating to the Senior Secured Notes and/or the Senior Secured Note Indenture and any other document that may be entered into pursuant to any of the foregoing.

Senior Secured Note Documents has the meaning assigned to such term in the Indenture.

Senior Secured Note Documents means the Senior Secured Notes Indenture, the Senior Secured Notes and the “Guarantees” under and as defined in the Senior Secured Notes Indenture.

Examples of Senior Secured Note Documents in a sentence

• Mortgagor has received a copy of and is fully familiar with the terms and provisions of the Indenture and the other Senior Secured Note Documents.

• The obligations in respect of the 2010 Secured Notes and any Senior Secured Note Documents (as defined therein) will or have been designated as “Additional Obligations” under, and in accordance with, section 5.02(c) of the First Lien Intercreditor Agreement (the “ Secured Notes Designation”).

• Unless and until Mortgagee accepts any proposed cure of an Event of Default, such Event of Default shall be deemed to be continuing for purposes of this Mortgage and the other Senior Secured Note Documents.

• However it is important to note that this does not negate the additional accumulation of atmospheric greenhouse emissions that has occurred since FY2017 as a consequence of BHP’s activities.

• Thereafter, Mortgagor may use the balance of the Rents collected in any manner not inconsistent with the Senior Secured Note Documents.

More Definitions of Senior Secured Note Documents

Senior Secured Note Documents shall have the meaning assigned to such term in the preliminary statement.

Senior Secured Note Documents means, collectively, the Senior Secured Note Indenture, the Senior Secured Notes, the Senior Secured Note Guaranties, the Security Documents and each of the other agreements, documents and instruments providing for or evidencing any Senior Secured Note Obligation, any other document or instrument executed or delivered at any time in connection with any Senior Secured Note Obligation, including pursuant to the Security Documents, and any intercreditor or joinder agreement among holders of Senior Secured Note Obligations (or binding upon one or more of them through their representatives), to the extent such are effective at the relevant time, as each may be amended, supplemented, modified or Refinanced from time to time in accordance with the terms thereof and the Intercreditor Agreement.

Senior Secured Note Documents means any agreement or instrument governing or evidencing the Senior Secured Notes and the Liens on collateral securing the same, including without limitation the indenture, dated as of July 13, 2010, among the Borrower, Holdings, The Bank of New York Mellon, as trustee, and BNY Trust Company of Canada, as such documents may be amended, restated, supplemented or otherwise modified from time to time in accordance with the terms hereof.

Senior Secured Note Documents means the indenture, the notes, the Guarantees and the Security Documents.

Senior Secured Note Documents means and include each of the documents and other agreements entered into by the Borrower and Holding (including without limitation the Senior Secured Note Indenture) relating to the issuance by Borrower of the Senior Secured Notes, as in effect on the First Amendment Effective Date and as the same may be entered into, modified, supplemented or amended from time to time to the extent permitted pursuant to the terms hereof and thereof.

Senior Secured Note Documents shall have the meaning provided in the recitals to this Agreement.

Senior Secured Note Documents means (a) the Senior Secured Notes, the Senior Secured Notes Guarantees, this Senior Secured Notes Indenture, the Security Documents, the First Lien Intercreditor Agreement, the 2007 UK Intercreditor Agreement and (b) any other related document or instrument executed and delivered pursuant to any Senior Secured Note Document described in clause (a) evidencing or governing any Secured Obligations thereunder.
