In case of any judicial proceeding relative to the Company or any Security Guarantor (or any other obligor upon the Securities), its property or its creditors, the Trustee shall be entitled and empowered, by intervention in such proceeding or otherwise, to take any and all actions authorized under the Trust Indenture Act in order to have claims of the Holders and the Trustee allowed in any such proceeding.
The following Trust Indenture Act term used in this Indenture has the following meaning: “obligor” on the Securities means the Company, each Security Guarantor and any successor obligor upon the Securities.
Any Security Guarantor not so released will remain liable for the full amount of principal of, premium, if any, and interest on the Securities as provided in this Article Seventeen.
Each Security Guarantor waives notice of any default under this Indenture, the Securities of such series or any other agreement.
Upon the Company's exercise of the above option applicable to this Section with respect to any Securities of or within a series, the Company and each Security Guarantor shall be deemed to have been discharged from its obligations with respect to such Outstanding Securities on the date the conditions set forth in Section 1404 are satisfied (hereinafter, "defeasance").
