  • The Trust and Servicing Agreement may be amended from time to time by the Depositor, the Certificate Administrator, the Servicer, the Special Servicer and the Trustee, without the consent of any of the Certificateholders or the RR Interest Owners, in certain circumstances specified in the Trust and Servicing Agreement, subject to certain exceptions set forth in the Trust and Servicing Agreement.

  • For the protection and enforcement of the provisions of this Section, each and every Certificateholder, every RR Interest Owner and the Trustee shall be entitled to such relief as can be given either at law or in equity.

  • If required in accordance with any such adjustment, each Class of Certificates or the RR Interest that has been notionally reduced as a result of the application of the Trust Appraisal Reduction Amount shall have its related Certificate Balance or RR Interest Balance notionally restored by the Certificate Administrator or the Trustee to the extent required by such adjustment of the Trust Appraisal Reduction Amount, and there shall be a redetermination of whether a Control Event has occurred.
