Before each Sub-Processor processes Personal Data, Supplier shall: (a) carry out due diligence and enter into written contract with the Sub-Processor to ensure that the Sub-Processor shall provide the same level of protection for Personal Data as required by this DPA and Article 28(3) of the GDPR; and (b) if that arrangement involves a Restricted Transfer, ensure that such Sub-Processors have an appropriate transfer mechanism in place.
To the extent the Processing of Personal Data under this DPA involves a Restricted Transfer (either directly or via onward transfer) by the Processor or its Sub-processors (including the Processor’s Affiliates), any such transfer shall only be made subject to the Standard Contractual Clauses or an alternative recognized compliance mechanism for Restricted Transfers as set out in Article 46 of the GDPR or Article 16 of the FADP, as applicable.
Appropriate Safeguards The standard of protection over the personal data and of data subjects’ rights, which is required by UK Data Protection Laws when you are making a Restricted Transfer relying on standard data protection clauses under Article 46(2)(d) UK GDPR.
Laserfiche shall not participate in (nor permit any Subprocessor to participate in) any other Restricted Transfers of Personal Data (whether as an exporter or an importer of the Personal Data) unless the Restricted Transfer is made in full compliance with Applicable Data Protection Law.
Where a Restricted Transfer is made from the UK, the UK Addendum is deemed executed between Customer and Supplier and the EU SCCs (as modified above) shall apply as amended by the UK Addendum.
