All such discussions and communications related thereto shall (unless otherwise agreed by AGCO and Trimble) be governed by Rule 408 of the Federal Rules of Evidence and any applicable similar state rule, and any resolution by them agreed to in writing as to any objections, if the same are so resolved within the Resolution Period, and the Closing Working Capital Statement with such changes as may have been previously agreed in writing by AGCO and Trimble, shall be final and binding.
Any party involved in such Dispute may submit the Dispute to the AAA to commence the proceedings after the Resolution Period.
