TxDOT may reject the Request for Change Order at any point in the process.
Each incomplete Request for Change Order shall: (a) include a list of those Change Order requirements that are not fulfilled together with an explanation satisfactory to TxDOT stating why such requirements cannot be met and (b) in all events include sufficient detail to ascertain the basis for the proposed Change Order and for any Maintenance Price increase associated therewith, to the extent such amount is then ascertainable.
After delivery of a PCO Notice, DB Contractor must submit a Request for Change Order in accordance with Section 4.5.6 as a condition precedent to receipt of a Change Order.
TxDOT’s denial or disapproval of a requested Deviation shall be final and not subject to the dispute resolution procedures under Section 4.7. TxDOT may elect to process the application as a Request for Change Order under Section 4.5 hereof and Section 5 of the CMA rather than as an application for a Deviation.
Upon TxDOT’s approval of the matters set forth in the Request for Change Order submitted by DB Contractor (whether it is initiated by TxDOT or requested by DB Contractor), TxDOT shall prepare a Change Order for execution by the Parties.
