Reliable information definition

Reliable information means information worthy of confidence, including any information whose use at sentencing is permitted by the United States Constitution.
Reliable information means any observance or detection of VOC emissions from a Tank System, associated open-ended line (e.g., vent line, blowdown valve or line), or associated pressure relief device using an optical gas imaging infrared camera, EPA Method 21 monitoring, CDPHE Approved Instrument Monitoring Method (“AIMM”), or audio, visual, olfactory (“AVO”) techniques by EPA, CDPHE, local government inspectors acting as duly designated representatives of CDPHE, PDC employees, or PDC contractors trained to conduct inspections for emissions. For purposes of this Decree only, evidence of surface staining alone shall not be considered Reliable Information. As to combustion devices used in a Vapor Control System, Reliable Information shall also include any observance or detection of Visible Smoke Emissions by EPA, CDPHE, local government inspectors acting as duly designated representatives of CDPHE, PDC employees, or PDC contractors trained to conduct inspections for emissions. Reliable Information may be obtained at any time.

Reliable information means data, studies and other information that have been:

Reliable information means any observance or detection of VOC emissions: 1) from a Storage Tank opening (i.e., PRD/thief hatch), except during gauging or maintenance; or 2) from a combustion device used in a Vapor Control System without flame presence indicating combustion. Reliable Information must be observed or detected: 1) using an optical gas imaging infrared camera, EPA Method 21 monitoring, or AVO inspection; and 2) by EPA, XTO employees, or XTO contractors trained to conduct inspections for emissions. For purposes of this Decree only, evidence of staining alone shall not be considered Reliable Information. As to combustion devices used in a Vapor Control System, Reliable Information shall also include any observance or detection of no pilot light present by EPA, XTO employees, or XTO contractors. Observations from a Tank System while all wells associated with that Tank System are temporarily shut-in, and during which working and standing emissions may occur, will not be considered Reliable Information.
Reliable information means any observation or detection, when collected by employees or contractors of the EPA, PADEP, government contractors, trained Hilcorp employees, trained Hilcorp contractors, or the Verifier of: (i) VOC emissions from a Vapor Control System, an open bypass device or any bypass device as described in Paragraph 44, an open thief hatch, an open pressure relief device, or open-ended line while using an optical gas imaging camera, AVO techniques, or EPA Method 21 monitoring techniques; (ii) any deviation indicated by a Subject Storage
Reliable information means: (a) any observance or detection of VOC emissions from a Vapor Control System or LEAF Vapor Control System, or associated open-ended line while using an IR Camera, the EPA Method 21 monitoring, or AVO techniques by the EPA, MHA Nation Energy Division staff, Marathon employees, or Marathon contractors trained to conduct inspections for emissions; and (b) any observance or detection of Visible Smoke Emissions from a combustion device associated with a Tank System or LEAF Tank System by the EPA, MHA Nation Energy Division staff, NDDEQ, Marathon employees, or Marathon contractors trained to conduct inspections for emissions. Reliable Information may be obtained at any time after the Date of Lodging. For purposes of this Decree alone, the following shall not be considered Reliable Information:
Reliable information means any of the following information, observations or detections of emissions by employees or contractors of EPA, NMED, or the Texas Commission on Environmental Quality, Apache employees, trained Apache contractors, or the Verifier, from a Subject Vapor Control System: (i) any observance or detection of VOC emissions from a bypass device open to the atmosphere, an open thief hatch, an open PRV, or an open-ended line, while using an optical gas imaging camera, AVO techniques, or EPA Method 21 monitoring techniques; (ii) Visible Smoke Emissions from a combustion control device;
Reliable information means information the chief executive reasonably believes is accurate.
