Expected changes in the Port’s capacity utilisation during the Relevant Term may impact on PNO’s incentives to provide access.
For instance, if the Port is likely to become capacity constrained over the Relevant Term, it may have altered incentives to provide access to certain types of users (such as those that are likely to generate higher levels of profit for it), or to price discriminate between them.
