Nothing in this Section affects KASB’s right to commence or prosecute an action under Proposition 65 against a Releasee that does not involve Kingsum’s Products.
However, the Executive does forever release the Executive’s right to recover or receive from any Releasee any personal relief, monetary damages, attorneys’ fees, back pay, reinstatement or injunctive relief, with the exception of any whistleblower awards or incentives that may be available for information provided to the Department of Justice, the Securities and Exchange Commission, Congress, or any federal Inspector General.
The Parties further understand and agree that this Section 4.1 release shall not extend upstream to any individual or entity that manufactured the Products or any component parts thereof, or any distributor or supplier who sold the Products or any component parts thereof to Kingsum, nor shall it extend downstream to any Releasee instructed by Kingsum to provide a warning and who fails to do so.
For greater certainty and without limiting the generality of the foregoing, the Releasors shall not assert or pursue a Released Claim against any Releasee under the laws of any foreign jurisdiction.
