Employee - Following any lost time occupational injury or illness of five consecutive workdays or more, the employee obtains written medical authorization from the treating physician to return to work.
No later than the fifth (5th) Business Day after the occurrence of a Release Trigger Event, the Company shall deliver an Officer’s Certificate to the Trustee specifying (i) such Release Trigger Event and the Collateral Release Excess Proceeds in respect thereof; (ii) any Property or Capital Stock that has become Excluded Released Property as a result of such Release Trigger Event; and (iii) any Subsidiary that has become an Excluded Non-Guarantor Subsidiary as a result of such Release Trigger Event.
Upon the satisfaction of all such conditions precedent, the Term of this Lease will thereupon end as to the Released Property.
Such Replacement Property does not have to serve the same function as the Released Property it is replacing.
Replacement Property qualifies for Negotiated FILOT Payments up to the original income tax basis of the Released Property which it is replacing in the same Property Tax Year.
