Any said action to correct said prior Release of Public Information shall, to the extent possible, serve to inform the public capital markets and any person who directly or personally received the prior release of Public Information, of the nature and extent of the corrected information.
The provisions of clause (ii) of Section 4(b) shall not be applicable for the period from and after the time at which the conditions set forth in the immediately preceding sentence shall have been satisfied (or, if later, the time that is 24 hours after the time that the relevant Earnings Release was first publicly released) through and including the time that is 24 hours after the Filing Time of the relevant Quarterly Report on Form 10-Q or Annual Report on Form 10-K, as the case may be.
The Collateral Agent shall not be liable to the Loan Parties, the Secured Parties or any other Person for any Environmental Actions or any liability arising under any Environmental Law by reason of the Collateral Agent’s actions and conduct as authorized, empowered and directed under the Loan Documents or relating to the presence, Release or threatened Release of Hazardous Materials.
SECTION 7 - INDEMNITY AND INSURANCE 7.1 Indemnification, Release and Waiver.
This General Release covers only those claims that arose prior to your execution of this Agreement.
