Reimbursement Cap definition

Reimbursement Cap has the definition set forth in Section 3.8.1 (Support).

Reimbursement Cap means (i) Two Million Dollars ($2,000,000.00) while the Stay Order is in effect; and (ii) Two Million, Five Hundred Thousand Dollars ($2,500,00.00) if either the Stay Order is lifted while proceedings relating to this Settlement are ongoing or if any Additional Securities Action is filed that is not stayed.

Reimbursement Cap means Seven Hundred and Fifty Thousand Dollars ($750,000).

Examples of Reimbursement Cap in a sentence

• The County agrees to pay the Annual Payments to the District commencing November 1, 2023, and continuing each year thereafter until all the Road Improvement Costs have been paid in full or the Reimbursement Cap has been met.

• Any such excess payment shall be directly applied to the remaining balance of Road Improvement Costs and counted toward the Reimbursement Cap.

• The Parties further agree that the District may make such adjustments to the Road Improvements provided any adjustment does not exceed the Reimbursement Cap.
