Recording Costs definition

Recording Costs shall include, without limitation, all minimum union scale payments made to you, all payments made to any other individuals rendering services in connection with the production and recording of the Masters (including, without limitation, the individual producers and co-producers of the Masters), all other payments which are made pursuant to any applicable law or regulation or the provisions of any collective bargaining agreement between us and any union or guild (including, without limitation, payroll taxes and payments to union pension and welfare funds and/or health and retirement funds), all amounts paid or incurred for studio or hall rentals, tape, engineering, editing, mixing, remixing, instrument rentals and cartage, mastering, transportation and accommodations, immigration clearances, trademark and service ▇▇▇▇ searches and clearances, any so-called "per diems" for any individuals (including you) rendering services in connection with the recording of the Masters, together with all other amounts paid or incurred in connection with the production, recording and delivery to us of the Masters. Recording Costs shall be recoupable from royalties payable by us hereunder.
Recording Costs means all costs incurred with respect to the production of Masters embodying the Artist's performances, including audio visual recordings, and which are customarily recognized as Recording Costs in the phonograph record industry including but not limited to all expenses incurred in connection with the production of audio and/or visual masters and all payments and/or advances to Artist hereunder, as well as payments to all of the musicians (including without limitation, instrumentalists, leaders, arrangers, orchestrators, copyists and contractors) vocalists and producers, if any, rendering services in connection with any recordings hereunder, payments to union pension and welfare funds, costs of cartage and instruments hire, studio or hall rentals, editing costs, distribution fees, licensing fees, payroll taxes and other payments to third parties on Artist's behalf, tour support, liability and medical insurance and legal accounting fees payable to Artist's own legal counsel or accountant (if any such payments are actually made by Company) and customary artwork if done by other than in-house artists, all taxes, third parties fees, fees for replay or a sampling licenses, and other reasonable expenses incurred by Company for the purpose of production of the Masters and Records and all costs attributed to promotional costs, marketing and advertising costs expended in furtherance of the sale of Records produced from the Masters.

Examples of Recording Costs in a sentence

  • Additionally, we shall have the right, at our election, with or without cause, to refuse to permit you to fulfill your then-current Recording Commitment for any Contract Period including, without limitation, by discontinuing recording sessions for any Masters and ceasing the payment of Recording Costs for any Masters.

  • Any amounts paid by us in connection with any search or registration shall be deemed to be Recording Costs pursuant to subparagraph 5(b) above.

  • Company shall pay the Recording Costs of the Masters recorded at recording sessions conducted pursuant to this Agreement in any amount not in excess of the recording budget.

  • Company shall have final decision on all money to be spent on all recording costs ("Recording Costs").

  • You will engage all artists, producers, musicians, and other personnel for the recording sessions hereunder, but only after you submit a written budget listing all Recording Costs to be incurred in connection therewith and after you receive written approval of such budget signed by one of Universal's officers (the "Authorized Budget").


More Definitions of Recording Costs

Recording Costs all costs representing direct expenses incurred by the Company in connection with the pre-production, production and post-production of Master Recordings made under this Agreement that are customarily considered "Recording Costs" in the record industry.
Recording Costs means all costs and charges generally recognised as recording costs in the record industry which are incurred in respect of the recording of Audio Material hereunder including all costs of recording, mixing and remixing, sequencing, dubbing, editing, digitising or format conversion (PROVIDED THAT Company shall only be entitled to recoup one set of format conversion costs per Record per format), DVD authoring (save in connection with the creation of DVD Videos where the applicable costs shall be deemed part of the applicable budget and recouped accordingly) and 5.1 remixing, the creation of enhanced formats (e.g. CD-Plus), mastering and re-mastering and any costs of cutting of lacquers and production masters Provided that fifty per cent (50%) per Track of mastering and cutting costs in respect of any Record released by Company in the USA shall be non-recoupable and non-deductible and shall not fall within this definition; and the advances, fees and expenses of producers, engineers, mixers and remixers, musicians, vocalists, arrangers, copyists and conductors; and all studio charges, porterage, instrument and equipment rentals and purchases; and all costs for arrangements, orchestrations and copying; and all union scale payments due to all persons who render performances or services in connection with recording sessions (and all taxes required to be paid thereon if not recovered by Company), and all fee-based amounts payable pursuant to any collective bargaining agreement between Company and any union representing persons who render performances or services in connection with recording sessions; and all travel and living expenses (if any) required for session participants and others (including Artist).
Recording Costs. Wages, fees, advances and payments of any nature to or in respect of all musicians, vocalists, conductors, arrangers, orchestrators, engineers, producers, copyists, etc.; payments to a trustee or fluid based on wages to the extent required by any agreement between Company and any labor organization or trustee; union session scale payable to Artist; all studio, tape, editing, mixing, re-mixing, mastering and engineering costs; authoring costs; all costs of travel by persons other than Company employees, per diems, rehearsal halls, non-studio facilities and equipment, dubdown, rental and transportation of instruments; all costs occasioned by the cancellation of any scheduled recording session; and all other costs and expenses incurred in the production, but not the manufacture, of Masters and Records hereunder, and any Demos hereunder, which are then customarily recognized as recording costs in the recording industry. Notwithstanding anything to the contrary contained herein, any Recording Costs for all remixes from any particular Album which are paid, incurred or reimbursed by Company after Delivery of the Masters constituting the Album concerned shall be recoupable solely from royalties (other than mechanical copyright royalties) payable to Artist hereunder and shall not be recoupable from Advances. If Company furnishes any of its own facilities, materials, services or equipment for which Company has a standard rate, the amount of such standard rate or if there is no standard rate, the market value for the services or thing furnished shall be deemed Recording Costs. Payments to the AFM Special Payments Fund and the Music Performance Trust Fund based upon record sales (so-called "per-record royalties") shall not be recoupable from your royalties or reimbursable by you.
Recording Costs all amounts representing direct expenses paid or incurred by Company in connection with the pre-production, production and post-production of Master Recordings made hereunder which are customarily considered "Recording Costs" in the record industry. Recording Costs include, without limitation, all costs advances and fees incurred for travel, lodging, immigration clearances, all producers, engineers, other technical and creative personnel, and others reasonably necessary for the production process (including Company's executives), all rehearsal and equipment rental expenses, cartage, and to all entities providing goods and services for the Masters recorded hereunder, personnel or otherwise, the costs of mastering and remixing, the costs of lacquer, copper and other equivalent masters, Company Artist and amounts paid to collective bargaining organizations, pension and welfare fluids based on wages, and other amounts paid by Company in connection with the recording and delivery of Master Recordings made hereunder.
Recording Costs means wages, fees, advances and payments of any nature to or in respect of all musicians, vocalists, conductors, arrangers, orchestrators, engineers, producers, copyists, etc.; payments to a trustee or fund based on wages to the extent required by any agreement between artist and any labor organization or trustee; union session scale payable to artist or musicians; all studio, tape, editing, mixing, re-mixing, mastering and engineering costs; artist development costs, authoring costs; all costs of travel, per diems, rehearsal halls, non-studio facilities and equipment, dubdown, rental and transportation of instruments; all costs occasioned by the cancellation of any scheduled recording session; all amounts paid in connection with the production, conversion, authoring, mastering and delivery of audiovisual materials prepared for or embodied on Subject Project / Property Rights; all expenses of clearing and licensing any samples embodied on Subject Project / Property Rights hereunder; and all other costs and expenses incurred in the production of Subject Project / Property Rights hereunder or otherwise made in connection with artist, which are then customarily recognized as recording costs in the recording industry.
Recording Costs means all direct expenses paid or incurred in connection with the production, mixing and mastering of the Master including but not limited to studio rentals, tape, engineering, editing, instrument rental, and mastering, any per diems of any other person rendering services in connection with the recording of the Masters.
