Prior to beginning research under this CRADA, the Principal Investigator shall obtain VA Research and Development (R&D) Committee approval of the Protocol.
Each party to this Agreement shall retain the rights, powers, and discretion granted to it under this Agreement, and no such rights, powers, or discretion shall be delegated to or vested in the R&D Committee unless such delegation or vesting of rights is expressly provided for in this Agreement or the parties expressly so agree in writing.
The Protocol or SOW may be modified by mutual written consent of Collaborator and the Principal Investigator only for changes in clinical activities, subject to approval, if required, by the IRB and R&D Committee.
Each party shall designate one (1) of its representatives to be such party’s “R&D Committee Leader.” Each party shall notify the other of its initial representatives and R&D Committee Leader within ten (10) business days after the execution of this Agreement.
From time to time, each party may substitute its representatives or R&D Committee Leader on three (3) days’ prior written notice to the other party.
