Proposed Class definition

Proposed Class means a proposed class consisting of approximately 3716 persons resident in Alberta and throughout Canada and abroad, who were employees of the City and whose personal information was included in the Disclosure.
Proposed Class means the class of plaintiffs defined in Plaintiffs’ First Amended Complaint filed in the ▇▇▇▇▇ ▇. ▇▇▇▇▇▇▇▇▇▇.
Proposed Class or “Proposed Class Members” means Plaintiff and all other individuals who were employed by Defendant in the State of Washington as non-exempt, hourly employees at any time during the Settlement Class Period.

  • Each Proposed Class Member who does not submit a valid and timely request for exclusion will automatically be a Settlement Class Member and eligible to receive a Settlement Award.

  • The Parties agree that neither they nor their counsel will solicit or otherwise encourage any of the Proposed Class Members to opt out or object to the Settlement or to appeal from the Superior Court’s Final Judgment approving the Settlement.

  • Proposed Class Members who fail to submit a valid and timely Exclusion Letter on or before the Notice Deadline shall be deemed Settlement Class Members and shall be bound by all terms of the Settlement and any Final Judgment entered in this Case if the Settlement is approved by the Superior Court, regardless of whether they have objected to the Settlement.

  • Notwithstanding the foregoing, the Settlement Administrator or Class Counsel may mail or email a Notice of Settlement and/or Exclusion Form to a Proposed Class Member at an address or email address obtained by other means if the Notice of Settlement is returned as undeliverable or upon the Proposed Class Member’s request for the same.

  • The Settlement Administrator shall also have the responsibility to determine any Proposed Class Member’s eligibility for a Settlement Award (i.e., to determine whether any Proposed Class Member is a Settlement Class Member).


More Definitions of Proposed Class

Proposed Class or “Proposed Class Members” means all individuals who were employed by ▇▇▇▇▇▇▇ in the State of Washington in positions paid on an hourly basis at any time during the Class A Settlement Class Period and/or who applied for employment and/or were employed by ▇▇▇▇▇▇▇ in the State of Washington during the Class B Settlement Class Period.
Proposed Class or “Proposed Class Members” means all individuals identified in paragraph 4.1 of the Complaint who are/were employed by the Company in positions performing onsite services in Washington state at any time during the Settlement Class Period. Positions include, but are not limited to, certified service technicians, line testers, certified electricians, plumbers, factory certified electronic technicians, or individuals in positions performing similar functions.
Proposed Class or “Proposed Class Members” means all individuals who resided in Washington State and who were employed by EOH as a non-exempt, hourly restaurant worker (including front of house and/or back of house positions) at an ▇▇▇▇▇▇▇’▇ Oyster House restaurant in Washington state at any time during the Settlement Class Period. EOH represents that there are approximately 227 Proposed Class Members.
Proposed Class or “Proposed Class Members” means all individuals who worked as hourly employees for Defendants at any time during the Settlement Class Period, except for 54 employees who signed declarations affirming they received all breaks while working for Defendants and are therefore excluded as a Class Member. The Proposed Class does not include those employees that have entered into settlement agreements with Defendants releasing the claims at issue during the Settlement Class Period. This exclusion does NOT include Plaintiffs nor Class Member ▇▇▇▇▇▇ ▇▇▇▇▇▇. Plaintiffs and ▇▇. ▇▇▇▇▇▇ are included in Proposed Class Members.
Proposed Class or “Proposed Class Members” means Plaintiffs and all other individuals who were employed by Defendant in the State of Washington as hourly-paid protective security guards at any time during the Settlement Class Period.
Proposed Class means all EDD claimants who have an existing UI claim where the claimant has received at least one payment and has certified eligibility for benefits for at least one additional week and whose eligibility EDD is investigating for past, current or future weeks or who currently have a pending appeal from a determination terminating a continuing claims series.
Proposed Class or “Proposed Class Members” means each and every individual who was employed by Hy-Security Gate Inc. or NNA, and worked one or more shifts as a non-exempt hourly-paid employee in the State of Washington at any time during the Settlement Class Period.
