Property Condition definition
Property Condition shall have the meaning given in Section 6.9.
Property Condition. Space offered is accepted “as is”. Any proposed changes/alterations to the space shall be the sole responsibility of the Lessee, with prior approval of the Contracting Officer. Submissions of plans/drawings shall be through the Property Manager or designated representative. No cards, signs, or billboards may be installed, other than signage as may be required by the Lessor. Camouflage in the form of an enclosure and landscaping/coloration of the cabinetry is required and to the satisfaction of the Lessor. A concrete or other suitable pad may be installed for the antenna, antenna support structure and shelter, provided it does not exceed the square footage allocated within the terms of the lease. No change in antenna support structure height or additional cabinetry, without the prior written consent the Contracting Officer. Cabinets shall not be stacked for any reason. Consent will not be unreasonably withheld or delayed for requested changes or approvals. Lessor shall provide key access on a twenty-four (24) hour basis, seven (7) days a week, provided the Lessor has been informed after-hours access is required.

Property Condition. The site is zoned “M” Multi-Family District. The Multi-Family District requires a minimum lot area of 15,000 square feet per development or approximately 0.35 acres. The site will be located within a moderate flood hazard area, also known as the 500-year flood zone Sources and Uses Insurance Status: Insurance is not applicable to the proposed development site as it will undergo new construction.
Property Condition means each and every matter of concern or relevance to Buyer relating to the Property, including without limitation the financial, legal, title, physical, geological and environmental condition and sufficiency of the Property and all improvements and equipment thereon; applicable governmental laws, regulations, and zoning; building codes, and the extent to which the Property complies therewith; the fitness of the Property for Buyer’s contemplated use; the presence of hazardous materials; title matters; and contracts to be assumed by Buyer. Upon Closing, Buyer hereby waives, releases, acquits, and forever discharges Seller, and Seller’s agents, directors, officers, and employees to the maximum extent permitted by law from any and all claims, actions, causes of action, demands, rights, liabilities, damages, losses, costs expenses, or compensation whatsoever, direct or indirect, known or unknown, foreseen or unforeseen, that it now has or which may arise in the future on account of or in any way growing out of or connected with Property Condition.
