Posting Party means, at any time, the Party required to post, or that has posted, Performance Assurance to, or for the benefit of, the Beneficiary Party.

Posting Party means the Party required to deliver Eligible Collateral and “Secured Party” shall mean the Party entitled to receive Eligible Collateral pursuant to Paragraph 3 as the context requires.

Examples of Posting Party in a sentence

• To the extent a Party requires Performance Assurance and/or has received a credit support document under this Agreement, then the Posting Party hereby grants to the Secured Party a present and continuing security interest in same.

• Collateral that is drawn upon by a Secured Party shall not relieve the Posting Party of the obligation to post in full, as of the next Posting Deadline, any and all Collateral required in satisfaction of its then-current Collateral Requirement, if any.

• If the Posting Party fails to Cure or if a Letter of Credit expires or terminates without a full draw thereon by the Secured Party, or such Letter of Credit fails or ceases to be in full force and effect at any time that such Letter of Credit is required pursuant to the terms of this Agreement, then the Posting Party shall have failed to meet its obligations pursuant to this Article VIII or Article XI, as applicable.

• All Collateral drawn by a Secured Party shall be applied toward satisfaction of the obligations of the Posting Party to the Secured Party under this Agreement.

• Rejection of a Replacement Letter of Credit under the immediately prior sentence shall not relieve a Posting Party of its obligations to maintain adequate Performance Assurance at all times under this Collateral Annex.

More Definitions of Posting Party

Posting Party is defined in Paragraph 3. It is possible for either Party to be a Posting Party at some times and a Secured Party at other times and also possible for a Party to be both a Posting party and a Secured Party at the same time. “Posting Party” shall mean the Party required to deliver Eligible Collateral and “Secured Party” shall mean the Party entitled to receive Eligible Collateral pursuant to Paragraph 3 as the context requires.

Posting Party means a Party that is obligated to post, or posts, Collateral under this Agreement.
