Port User definition

Port User means any person or entity in the Port at any time for any reason.

Port User means, without limitation, any owner, shipper, consignee, agent, hirer, licensee, visitor, occupier, invitee or other entity or person being present at the Port and/or having access to and/or use of the Port’s infrastructure and facilities;

Port User means and include the owner, lessee, charterer, operator or manager of any vessel and/or road carrier or any person for whom Council provides or is to provide a Port related service and/or any person who is or who appears on reasonable grounds to be an agent for or a representative of any one or more of the foregoing and/or any lessee/licensee or sub-lessee/ sub- licensee of Council in respect of Port of Greymouth and/or any contractor who has cause to work within the Port Area and the obligations and liabilities under these conditions of all or any such persons, if there be more than one, shall be joint and several.

• Choose the Proxy Type and enter Host, Port, User Name and Password.

• Meeting the obligation to pay The payment obligation of the Port User is deemed to have been met only when the HPA can definitely and finally dispose of the amount.

• Entitlement to offset / retain payments Port Users are only entitled to offset and/or retain payments against port fees and charges payable to the HPA if the counterclaims of the Port User are undisputed or have been recognised by declaratory judgment.

• Otherwise such data will only be communicated with the consent of the Port User concerned.

• Insofar as the port fees and charges actually paid by a Port User in a previous calendar year exceed the amount that the Port User owes after the reductions retroactively granted have been applied, the HPA will refund the Port User the amount overpaid.

More Definitions of Port User

Port User means any person who performs work or provides a service at Northport, for example as (i) a Northport Ltd employee, or (ii) a port related business, or (iii) a port related business employee, including in a regulatory capacity or (iv) a contractor, or (v) an employee of a contractor, or (vi) an employee of a labour hire agency; providing such work is as a matter of both right and practice, or (vii) a visitor; providing that the visitor has legitimate business at Northport.

Port User means any current or future user or provider of a port facility, port services, port terminals, port infrastructure, port repair facilities, off-shore cargo handling facilities or terminal operations Repeal of section 4 of Act 12 of 2005

Port User means any Cargo Owner, Ship owner or other person using the Port for any purpose whatsoever.

Port User means a person who, either directly or through agents, avails of the services or facilities offered by any Major Port Authority and includes representative bodies of such port users.

Port User means any person authorised by PPA to cause a vessel owned or chartered by it to berth at or depart from the Port. PPA and the Licensee (acting in any capacity other than licensee under this Licence) or any of their related entities shall be regarded as a Port User if they request the Licensee to provide a Service to them.

Port User means the individual or group or the company or their authorised agency who uses the services of the port;
