PHI definition

PHI shall have the meaning given to such term under the HIPAA regulations in 45 CFR § 160.103.

Examples of PHI in a sentence

  • Business Associate will ensure that any agent, including a subcontractor, to whom Business Associate provides PHI received from, or created or received by, Business Associate on behalf of Covered Entity agrees, in writing, to substantially the same restrictions and conditions that apply through this BAA with respect to such information, including implementation of reasonable and appropriate safeguards to protect PHI.

  • Except as otherwise limited in this BAA, Business Associate may Use PHI to provide Data Aggregation services as permitted under 45 C.F.R. §164.504(e)(2)(i)(B) and pursuant to any agreements between the Parties evidencing their business relationship.

  • Business Associate shall indemnify, defend, and hold harmless Covered Entity and its affiliates from and against any claims, losses, expenses or other costs (including reasonable attorneys’ fees) arising from or relating to (i) the breach of this Agreement by Business Associate or (ii) any use or disclosure of PHI by Business Associate or its employees, subcontractors or agents that does not comply with the terms of this Agreement.


More Definitions of PHI

PHI means any protected health information, including, without limitation any information whether oral or recorded in any form or medium: (i) that relates to the past, present or future physical or mental condition of an individual; the provision of health care to an individual; or the past, present or future payment for the provision of health care to an individual; and (ii) that identifies the individual or with respect to which there is a reasonable basis to believe the information can be used to identify the individual. PHI includes, but is not limited to, any information defined as Individually Identifiable Health Information by the federal Health Insurance Portability and Accountability Act.
PHI means any protected health information, including, without limitation any information whether oral or recorded in any form or medium: (i) that relates to the past, present or future physical or mental condition of an individual; the provision of health care to an individual; or the past, present or future payment for the provision of health care to an individual; and
PHI means any information, whether oral or recorded in any form or medium that relates to the past, present, or future physical or mental condition of an individual, the provision of health and dental care to an individual, or the past, present, or future payment for the provision of health and dental care to an individual; and that identifies the individual or with respect to which there is a reasonable basis to believe the information can be used to identify the individual. PHI shall have the meaning given to such term under HIPAA and HIPAA regulations, as the same may be amended from time to time.

PHI does not include education records covered by the Family Educational Right and Privacy Act, as amended, 20 USCA 1232g(a)(4)(b)(iv).
