The Council's approval must be obtained to both the Permitted Part and the proposed third party developer and (in the case of the latter) the Council will be entitled to have regard to (amongst other things) the questions and information it required from potential bidders at the Pre-Qualification Questionnaire stage of the procurement (as referred to in paragraph (viii) of the Background section in this Agreement, and Unacceptable Construction Companies.
Each underlease shall contain provisions requiring the undertenant to pay by way of additional rent the whole (in the case of an underletting of whole) or a fair and proper proportion (in the case of an underletting of a Permitted Part) of the Service Charge payable by the Tenant under this Lease.
