Permitted Hazardous Materials definition

Permitted Hazardous Materials means Hazardous Materials which are contained in ordinary office supplies of a type and in quantities typically used in the ordinary course of business within executive offices of similar size in the comparable office buildings, but only if and to the extent that such supplies are transported, stored and used in full compliance with all applicable laws, ordinances, orders, rules and regulations and otherwise in a safe and prudent manner. Hazardous Materials which are contained in ordinary office supplies but which are transported, stored and used in a manner which is not in full compliance with all applicable laws, ordinances, orders, rules and regulations or which is not in any respect safe and prudent shall not be deemed to be “Permitted Hazardous Materials” for the purposes of this Lease.
Permitted Hazardous Materials means Hazardous Materials in ordinary quantities which are customarily used in the operation, maintenance and repair of hotels and lodging facilities similar to the Property and which are stored and handled according to manufacturers' standards and guidelines and in compliance with all applicable Legal Requirements, and prepackaged office supplies, cleaning materials, personal grooming items and other similar items sold for consumer use.

  • Tenant shall keep Landlord fully and promptly informed of all Handling by Tenant of Hazardous Materials other than Permitted Hazardous Materials.

  • Notwithstanding the foregoing, normal quantities and use of those Hazardous Materials customarily used in the conduct of general office activities, such as copier fluids and cleaning supplies ("Permitted Hazardous Materials"), may be used and stored at the Premises without Landlord's prior written consent, provided that Tenant's activities at or about the Premises and Property and the Handling by Tenant of all Hazardous Materials shall comply at all times with all Environmental Requirements.

Permitted Hazardous Materials means Hazardous Materials which are contained in ordinary office supplies of a type and in quantities typically used in the ordinary course of business within executive offices of similar size and location and diesel fuel in quantities to serve the generator installed pursuant to Section 14.25 below, but only if and to the extent that such supplies and fuel are transported, stored and used in full compliance with all Hazardous Materials Laws and their packaging instructions and otherwise in a safe and prudent manner. Hazardous Materials which are contained in ordinary office supplies but which are transported, stored and used in a manner which is not in full compliance with all Hazardous Material Laws and their packaging instructions or which is not in any respect safe and prudent shall not be deemed to be Permitted Hazardous Materials for the purposes of this Lease.
Permitted Hazardous Materials means Hazardous Materials which are contained in ordinary office supplies of a type and in quantities typically used in the ordinary course of business within executive offices of similar size in the general area of the Buildings, but only if and to the extent that such supplies are transported, stored and used in full compliance with all applicable laws, ordinances, orders, rules and regulations and otherwise in a safe and prudent manner. Hazardous Materials which are contained in ordinary office supplies but which are transported, stored and used in a manner which is not in full compliance with all applicable laws, ordinances, orders, rules and regulations or which are not in any respect safe and prudent shall not be deemed to be “Permitted Hazardous Materials” for the purposes of this Lease.
Permitted Hazardous Materials means the types of quantities of Hazardous Materials which are listed on the schedule of Tenant’s Hazardous Materials attached hereto as Exhibit H. Without limitation, all Hazardous Materials brought into the Premises by or on behalf of Tenant shall at all times be brought to, kept at or used in so-called ‘control areas’ and in accordance with all applicable Hazardous Materials Laws and prudent environmental practice and good scientific practice. Tenant shall not, without the prior written consent of Landlord, bring or permit to be brought to or kept at, in or on the Premises, any Hazardous Material (excepting only Permitted Hazardous Materials). Provided Landlord complies with the terms of Section 8.1 hereof, Landlord may elect, from time to time, to inspect the Premises for compliance with the terms of this Section 5.3. With respect to any Hazardous Materials brought or introduced by Tenant in or on the Premises, or kept at or in the Premises, Tenant shall (i) not permit any such Hazardous Materials to be discharged, to escape, be released or be disposed in or about the Premises, and (ii) within five (5) business days of Landlord’s reasonable request, provide evidence reasonably satisfactory to Landlord of Tenant’s compliance with all applicable Hazardous Materials Laws, including copies of all licenses, permits and registrations that have not been previously provided to Landlord. Without limiting the foregoing, Tenant hereby represents and warrants to Landlord that at no time during the Term will Tenant bring upon, or permit to be brought upon, the Premises any radioactive materials, of any kind, whatsoever. Tenant shall immediately notify Landlord of any release or discharge of any Hazardous Materials, or of any incident in, on or about the Premises that would require the filing of a notice or other filing with a governmental agency or authority pursuant to any Hazardous Materials Laws. Tenant shall be responsible for assuring that any laboratory uses are adequately and properly vented.
Permitted Hazardous Materials shall have the meaning assigned and ascribed to such term as set forth in Section 6.1(a) of this Agreement.
Permitted Hazardous Materials shall be defined as: (i) standard office supplies stored in proper containers, (ii) those Hazardous Materials listed on Exhibit 5, and (iii) such other Hazardous Materials which Tenant uses in connection with its business in the Premises, provided that Tenant gives Landlord at least thirty (30) days prior written notice of the introduction of any such Hazardous Materials to the Premises by delivering for a Hazardous Material Questionnaire ("HMQ") in the form attached hereto as Exhibit 6, and provided that Tenant obtains Landlord's prior written approval of any such Hazardous Material, which approval shall not to be unreasonably withheld. Tenant shall only have the right to use an approved Hazardous Material subject to, and in accordance with, the terms of the HMQ provided by Tenant for such Hazardous Material. Tenant's disclosure obligations under this Article 17.6 shall include a requirement that, to the extent any information contained in an HMQ previously delivered by Tenant shall become inaccurate in any material respect, Tenant shall immediately deliver to Landlord a new updated HMQ. Landlord shall review and approve or disapprove Tenant's use of the Hazardous Materials disclosed in Tenant's completed Hazardous Materials Questionnaire within a reasonable time period following Landlord's receipt thereof.
Permitted Hazardous Materials means diesel fuel in amounts that can be stored in the Generator and related fuel tank, batteries (including those used in equipment providing uninterrupted power supply), as well as Hazardous Materials which are contained in ordinary office supplies of a type and in quantities typically used in the ordinary course of business within executive offices of similar size and location, but only if and to the extent that such fuel and supplies are transported, stored and used in full compliance with all Hazardous Materials Laws and their packaging instructions and otherwise in a safe and prudent manner. Hazardous Materials which are contained in ordinary office supplies or diesel fuel which are transported, stored and used in a manner which is not in full compliance with all Hazardous Material Laws and their packaging instructions or which is not in any respect safe and prudent shall not be deemed to be "Permitted Hazardous Materials" for the purposes of this Lease.
