Permitted Funds definition

Permitted Funds means the sum of the following:
Permitted Funds means, collectively, (i) any Person electing to be treated as a real estate investment trust under the Code or any fund (or group of related funds) (which, in each case, may be managed by the Borrower or any Restricted Subsidiary) that has as its primary investment objective (a) the origination or acquisition of Residential Mortgage Loans (performing or non-performing) or interests therein, including mortgage backed securities and/or (b) the acquisition and/or origination of MSR or interest therein (including excess servicing fee spread) and (ii) any similarly structured Affiliate or Subsidiary of any of the foregoing.

Examples of Permitted Funds in a sentence

  • The Keeyask Cree Nations agree with Hydro that a KCN Investment Entity’s Cash Payments to the Limited Partnership must be made using Permitted Funds, and the payment to Hydro of its Final Closing Cash must be made using funds that are allowed, in accordance with the applicable KCN Financing Agreement, to be used for such repayment.

  • If Hydro makes a determination that the monies proposed to be used in respect of the payment constitute Permitted Funds, then the KCN Investment Entity may proceed to make the payment, provided it also tenders a statutory declaration signed by a duly authorized officer certifying there has been no material change to any of the information or documents provided by the KCN Investment Entity pursuant to subsection 5.4.3.

  • The most recently available aggregate net asset value of the 10 largest positions of the Borrower in Permitted Funds shall not exceed 80% of the most recently calculated Gross Portfolio Value of the Borrower.

  • The Issuer shall cause the Custodian to instruct all Permitted Funds to make payments only to the Custody Accounts.

  • If the aggregate Adjusted Net Asset Value of the three (3) largest positions in Permitted Funds shall represent more than 37.5% of the Adjusted Gross Portfolio Value, the excess over 37.5% shall be deemed to have a value of zero when computing the Eligible Net Asset Value.

Permitted Funds means, collectively, (i) SerVertis Fund I L.P., a Delaware limited partnership, (ii) SerVertis Master Fund I L.P., an exempted limited partnership registered under the Exempted Limited Partnership Law (Revised) of the Cayman Islands, (iii) SerVertis Fund I Ltd., an exempted company incorporated and existing under the laws of the Cayman Islands, (iv) SerVertis REO LLC, a Delaware limited liability company, (v) SerVertis Depositor, LLC, a Delaware limited liability company, (vi) SerVertis SPV Holdings, LLC, a Delaware limited liability company, (vii) SerVertis Grantor Trust Holdings, LLC, a Delaware limited liability company, (viii) SerVertis GP, LLC, a Delaware limited liability company, (ix) any trust or similar Person, the beneficial interests of which are owned by the entities described in (i) – (viii) of this definition, (x) any Person electing to be treated as a real estate investment trust under the Code or any fund (or group of related funds) (which, in each case, may be managed by the Borrower or any Restricted Subsidiary) that has as its primary investment objective (a) the origination or acquisition of Residential Mortgage Loans (performing or non-performing) or interests therein, including mortgage backed securities and/or (b) the acquisition and/or origination of MSR or interest therein (including excess servicing fee spread) and (xi) any similarly structured Affiliate or Subsidiary of any of the foregoing.
Permitted Funds means funds used by a KCN Investment Entity to make any of its Cash Payments:
Permitted Funds means the proceeds of any equity issued by --------------- Holdings to a Person that will co-develop a market with Borrower or any of its Subsidiaries and which are contributed as equity to Borrower for the purpose of funding Market Co-Development Costs referred to in clause (ii)(F) of the definition of EBITDA for the purpose of developing a market in cooperation with such Person.
