Performance Warrant definition

Performance Warrant means that certain performance-based warrant to acquire shares of Common Stock issued to a strategic investor in the Company, or its affiliate, in connection with the original issuance of the same number of shares of Series C Preferred to such investor, or any affiliate thereof.
Performance Warrant mean the warrant issued by the Company to the Warrant Holder pursuant to the Purchase Agreement to purchase Common Shares upon meeting certain revenue performance requirements set forth therein.
Performance Warrant means a performance warrant entitling the Holder thereof to acquire a designated number of Common Shares from treasury at a price as determined in accordance with subsection 1(c);
