Pay-Per-View definition

Pay-Per-View or “PPV” means transmission and retransmission of synchronised video and audio signals of a single motion picture or program (or series of related program) where a supplemental charge on a per exhibition basis is made to a subscriber for the privilege of viewing the particular motion picture or program (or series of related program) at a time scheduled by the Exhibitor;
Pay-Per-View means a delivery of a single Program or a specified group of Programs, as to which each such single Program is generally uninterrupted by Commercial Advertising Messages and for which recipients are charged a separate fee for each Program or specified group of Programs. The term “Pay-Per-View” shall also include delivery of a single Program as described above for which multiple start times are made available at time intervals which are less than the running time of such Program as a whole. If a given delivery qualifies both as Pay-Per-View and a Pay Television Transmission, then, for purposes of this Agreement, such delivery shall be deemed Pay-Per-View rather than a Pay Television Transmission.
Pay-Per-View means the delivery and exhibition on viewing devices of a program to a consumer (i) for which such consumer pays a single per-consumer transaction fee (“PPV Charge”) for the privilege of viewing one or more exhibitions of such program, and (ii) the exhibition start times of which are specified by the provider of such program. “Pay-Per-View” shall not include making programs available for other than Personal Use (e.g., over hotel systems), or distribution on a free, ad-supported or subscription basis, or Video-On-Demand, Free-On-Demand or so-called electronic sell through, but shall not preclude DVR Functionality or remote booking of a recording of a pre-scheduled program to a Target Device.

Pay-Per-View means a telecast for which a fee is required in addition to any other fee paid by the viewer for any other services of the telecaster;
Pay-Per-View or “PPV” shall mean the transmission of a single motion picture transmitted by means of Television, on a linear pre-scheduled basis where the start time is scheduled by the distributor and not by the consumer and for which a transactional charge (in cash or in kind) is made to the consumer for the privilege of viewing the particular motion picture, alone or together with any goods or services that may be bundled therewith, on a per-exhibition basis. PPV may be offered on a multiple channel basis with varying scheduling patterns and may offer multiple exhibitions of a single motion picture over a period of time not to exceed 72 hours, but not on a Negative Option Basis. In addition, special limited promotional offers (including give-away coupons, free buys, extended viewing opportunities and the like) shall nevertheless constitute PPV; provided, that the provider making such offer may not make such offer available to any individual consumer for more than 60 days per Year. For this purpose, PPV does not include operating on a subscription basis and, therefore, shall not include any service for which a consumer is charged a “club” or other similar “access” fee (which shall not, for the purposes of this definition, be deemed to include any basic cable, digital/data plan or Internet access fee) solely for the privilege of being able to view motion pictures via PPV, unless such “club” or similar access fee is a nominal sum (i.e., an annual fee not to exceed $10) that is non-creditable against any per exhibition consumer transaction fees and in all events is a charge that is more than merely a fee to gain access to the PPV motion pictures alone. However, PPV may include a service where a consumer is required to pay an equipment rental fee or to purchase equipment in order to obtain such service, provided, that no part of such equipment rental fee or purchase price, as applicable, is credited or paid directly or indirectly to Licensor, and provided further that Licensor, when acting as a retailer and not a wholesaler, may receive an equipment rental fee or purchase price, as applicable, and such equipment rental fee or purchase price shall not count as a “club” or similar access fee, if a majority of Major Production/Distribution Studios, when acting as a retailer and not a wholesaler, are also receiving an equipment rental fee or purchase price. Pay-Per-View television shall mean the point-to-multi-point delivery of a single program to subscribers of a Delivery System for reception solely on a conventional television receiver (a) for which the subscriber pays a per-subscriber transaction fee solely for the privilege of viewing each separate exhibition of such program, or series of exhibitions over a period not to exceed 48 hours, which fee is unaffected in any way by the purchase of other programs, products or services, but not referring to any fee in the nature of a television set rental fee, (b) the exhibition start time of which (i) is at a time specified by the service provider and (ii) is more than five minutes after the most recently scheduled exhibition start time and (c) which is susceptible of and intended for viewing by such viewer on a television set simultaneously with the Streamed delivery of such program. Without limiting the foregoing, such program may be recorded simultaneously with the delivery thereof and stored on an Approved Set-top Box for viewing at a later time only if the Subscriber selects the program and at the same time or at a subsequent time elects to record and store such program on the Approved Set-top Box provided, however, that any program downloaded by a Subscriber for retention pursuant to this sentence must be automatically deleted upon the earlier of (i) 48 hours after such program is first played, (ii) 7 days after downloading; or (iii) the end of such program’s Licence Period. “Pay-Per-View” television shall include so-called “near video-on-demand” and shall not preclude VCR Functionality. “Pay-Per-View” shall not include video-on-demand, home video, electronic home video or sell-through or transmission via Interactive Media.
