Participating Store means (i) any Video Store in the United States, which at any time during the Term of this Agreement, is wholly owned and/or operated by Blockbuster or its Affiliates under the Blockbuster trademarks; (ii) if designated by Blockbuster as ordering Copies through Blockbuster, any Video Store in the United States, which at any time during the Term of this Agreement, is wholly owned and/or operated by Blockbuster or its Affiliates not under the Blockbuster trademarks; and (iii)
Participating Store means a store in the Mid-Coast Council Local Government Area which appears on the Participating Stores List;

The Participating Store reserves the right to decline, modify, suspend or terminate the Offer without liability.
Except as these Terms and Conditions specifically state, a Participating Store does not include by implication any other condition, term or warranty in respect of the quality, merchantability, acceptability, fitness for purpose, condition or description of a service or product provided in the applicable Participating Store.
Except for any liability not excluded by law, Entrants release and indemnify the Promoter and the Participating Store from and against all actions, claims and liabilities, that the Entrant now has or in the future may have against the Promoter and/or the Participating Store, for any loss, damage or injury (including any special or consequential loss) suffered as a direct or indirect result of the Entrant’s participation in the JAX Tyres & Auto Promotion.
The Promoter and/or a Participating Store will use, store and disclose any Customer Information only in accordance with their relevant Privacy Policy.
To the maximum extent permitted at law, the Promoter and each Participating Store (and their respective agents, employees and officers) exclude all liability for any actions, claims, costs, demands, expenses, liabilities or loss (including any consequential or indirect loss) of any kind whatsoever arising from or related to the JAX Tyres & Auto Promotion.
More Definitions of Participating Store
Participating Store means any Store that participates in the Program in accordance with the provisions of this Agreement, provided that, in the event that Xxx-Xxxx.xxx is added as a Party to this Agreement, all references in this Agreement to states in which Participating Stores are located shall include the states in which any Person(s) conducting a transaction under the Program with Xxx-Xxxx.xxx resides and, for purposes of this Agreement, any such transaction shall be deemed to be a transaction conducted at a Participating Store in such state.
Participating Store means (i) any Video Store in the United States, which at the relevant time during the Term of this Agreement, is wholly owned and/or operated by Blockbuster and/or its Affiliates under the Blockbuster trademarks; (ii) if designated by Blockbuster as ordering Copies through Blockbuster, any Video Store in the United States, which at the relevant time during the Term of this Agreement, is wholly owned and/or operated by Blockbuster and/or its Affiliates not under the Blockbuster trademarks which elect to participate pursuant to the terms and conditions hereof; and (iii) Franchise Stores which elect to participate pursuant to the terms and conditions hereof. For Copy quantity allocation purposes, Kiosks and Video Vending Machines (the "Special Formats") shall not be included in the definition of "Participating Stores."

For purposes of this Agreement, "video store" shall mean a retail outlet that is primarily, or is otherwise, in any material respect, engaged in the rental of videocassettes to the public for home viewing entertainment purposes.
