Participating Facility means, for purposes of this section only, with respect to covered service, a Hospital, Hospital outpatient department, critical access Hospital, ambulatory surgical center or any other facility as otherwise required by law, that has a direct or indirect contractual relationship with BCBSMT setting a rate (above which the provider cannot bill the Member) for furnishing such item or service under The Plan, regardless of whether the provider is considered a preferred or In-Network provider for purposes of In-Network or Out-of-Network Benefits under The Plan.

Participating Facility means, for purposes of this Amendment only, with respect to covered service, a hospital or ambulatory surgical center that has a contractual relationship with BCBSTX setting a rate (above which the provider cannot bill the member) for furnishing such item or service under the Plan to which this Amendment is attached. • Medical Care rendered by a Participating Professional Provider in charge of the Member’s case while an Inpatient in a Participating Facility Provider that is a Hospital, Rehabilitation Hospital or Skilled Nursing Facility for a condition not related to Surgery or pregnancy, or except as specifically provided.

• For nonemergency services performed by Non-Participating Providers during the Member’s visit at a Participating Facility, and for Emergency Services provided by a Non-Participating Provider or Non-Participating Emergency Facility, the Recognized Amount is used to calculate the Member’s cost-share requirements, including Deductibles, Copayments, and/or Coinsurance.

• Covered Services include: (1) facility services provided by a Participating Facility Provider that is a Hospital or Birth Center; and (2) professional services performed by an Obstetrician or Gynecologist that is a Physician or a certified nurse midwife.

• This does not include observation or reassurance of the Member, standby services, routine preoperative physical exams or Medical Care routinely performed in the pre- or post-operative or pre- or post- natal periods or Medical Care required by the Participating Facility Provider's rules and regulations.

• Consultations do not include staff consultations which are required by the Participating Facility Provider's rules and regulations.

For purposes of this Agreement, "Environmental Laws" means all laws (civil or common), ordinances, rules, regulations, guidelines, and orders that: (i) regulate air, water, soil, and solid waste management, including the generation, release, containment, storage, handling, transportation, disposition, or management of any Hazardous Substance; (ii) regulate or prescribe requirements for air, water, or soil quality; (iii) are intended to protect public health or the environment; or (iv) establish liability for the investigation, removal, or cleanup of, or damage caused by, any Hazardous Substance.

Participating Facility means any facility, the ownership interest of which is directly or indirectly owned or leased in full or in part by the Partnership.
