Outdoor Dining Area definition

Outdoor Dining Area means any privately owned or publicly owned area, street, or sidewalk, which is available or customarily used by the general public and which is designed, established, or regularly used for consuming food or drink.

Examples of Outdoor Dining Area in a sentence

  • All customers at a table may only purchase or consume food and alcohol from a single licensee associated with the Communal Outdoor Dining Area.

  • Outdoor Dining Area shall mean a designated area on the premises of a retail food establishment or restaurant, but outside the principal building, and where patrons may sit at tables while consuming food and beverages ordered from and served by a wait staff.

Outdoor Dining Area means an unenclosed area that is open to the general public, or closed to the public for a private function, where food and/or beverages are offered, served, or consumed, regardless of whether compensation is offered or given in exchange. Outdoor dining areas do not include any unenclosed dining area at a private residence.

Such areas include, but are not limited to, (i) a licensed unenclosed sidewalk café as defined in the §20-223(c) of the Administrative Code of the City of New York (Administrative Code) or successor provision, and (ii) an outdoor dining area not located on a sidewalk that is accessed directly from the street or through a passage of the establishment, if such passage is completely separated from any dining, food preparation or food, equipment or utensil storage areas of the establishment. An enclosed sidewalk café, as defined in §20-223(b) of the Administrative Code, is not an outdoor dining area.
