The Contractor shall have no right during the Contract Term to demolish or remove, in whole or in part, any Capital Investments and Fixed Improvements or Operating Facility except with the prior written consent of the Airports Authority, which may at the discretion of the Airports Authority be conditioned on the obligation of the Contractor to replace the same by Capital Investments and Fixed Improvements or Operating Facilities acceptable to the Airports Authority.
Title to the Operating Facilities shall vest in the Contractor during the Contract Term, and, at the expiration or termination of this Contract, shall remain with the Contractor.
When this Contract expires or is terminated in whole or in part as provided for elsewhere in this Contract, the Contractor shall surrender the Premises and Fixed Improvements and Operating Facilities therein in a state of good repair, with the exception of reasonable wear and tear and damage by loss or casualty not covered by insurance which the Contractor is required to maintain pursuant to this Contract and not otherwise attributable to the Contractor’s fault or negligence.
In addition, the Airline shall be responsible for operation and maintenance of all installed Airline Operating Facilities located within its Premises.
Following approval by the Authority, such Operating Facilities or Fixed Improvements shall be constructed, altered, installed, or removed in strict accordance with such plans and specifications, and in accordance with all applicable building code regulations, county, state and federal laws, ordinances and regulations, and with all applicable provisions of the Authority's Design Manual at the time of the construction, alteration, installation, or removal.
