Onerous Condition definition

Onerous Condition means any condition included in the Planning Permission or by means of a Planning Obligation which:
Onerous Condition means for these purposes, an action that requires a difficult or significant expenditure, in comparison to the size, resources and school budget; or changes in the structure of the institution not allowed by law or construction policies, in particular, those applicable to buildings of a historical heritage, as is the case of the school facilities. It is understood as any action or expense that may cause an overall negative impact on the institution. Onerous Condition means, in respect of an ORESS 1 Project, any of the following conditions contained in the Planning Consent for that ORESS 1 Project:

Examples of Onerous Condition in a sentence

  • After some argument, the Club agreed on 26 September 2013 that this was a Store Onerous Condition so that there was a deemed Planning Refusal for the purposes of the Agreement.

More Definitions of Onerous Condition

Onerous Condition means any Council’s Onerous Condition and/or Developer’s Onerous Condition as the case may be;
Onerous Condition means any condition imposed by a Planning Permission or required in any Planning Obligation which falls within any of the sub-paragraphs of paragraph 4;

Onerous Condition means (i) in the case of any condition on Buyer or its Affiliates (including, for these purposes, the Companies), a condition that would materially impair the ability of the Companies to conduct their business after the Initial Closing as conducted prior to the Initial Closing Date or (ii) in the case of any condition on the Sellers or their Affiliates (excluding the Companies), any condition that would materially impair the benefit to be derived by them from the transactions contemplated by this Agreement.
