Not Sustained; in that there is insufficient evidence to sustain the complaint.
Not Sustained –The internal investigation determined that there was insufficient evidence available to prove or disprove the allegation.
Following all criminal proceedings, if the Internal Affairs Office and the chain of review determine that the alleged felony or offense that could result in decertification, refusal to certify, or refusal to recertify by the POST Board is Not Sustained, is Unfounded, or is Exonerated, the Chief/designee or City Manager will determine within thirty (30) days if the employee will return to duty.
Unfounded, Exonerated, and Not Sustained investigations shall be removed from an employee’s files after one (1) year.
Not Sustained: Insufficient evidence to either prove or disprove the allegation.
