Non-Performing Party definition
Non-Performing Party. The Party who is in breach of, or is otherwise failing to perform, its obligations under this Agreement.
Non-Performing Party means a Party which is unable to perform all or any of its obligations by reason of Force Majeure;
Non-Performing Party means either the Affected Party or the Defaulting Party.

To the extent a Non-performing Party is entitled to defer certain liabilities pursuant to Article 7 (Force Majeure) of these General Terms and Conditions, the permitted period of deferral shall be governed by Section 7.6 (Termination for Force Majeure) in lieu of this Article 8 (Events of Default).
