Examples of Non-Extending Lender in a sentence
All Extension Requests must be approved by all Lenders and the Facility Agent to be effective, except for any Non-Extending Lender which has been or is expected to be repaid in full by June 26, 2029.
The Commitment of any Non-Extending Lender shall terminate on the Existing Maturity Date.
Any Lender that has not so advised the Borrower and the Administrative Agent by such day shall be deemed to have declined to agree to such extension and shall be a Non-Extending Lender; provided that a Non-Extending Lender (other than a Defaulting Lender) may, with the written consent of the Borrower, elect to become an Extending Lender by providing written notice of such election to the Borrower and the Administrative Agent at any time prior to the applicable Existing Maturity Date.
The Borrower shall have the right, pursuant to Section 5.14(b), at any time on or prior to the applicable Existing Maturity Date to replace any Non-Extending Lender with one or more Lenders or other financial institutions that will agree to the applicable Maturity Date Extension Request, and each such replacement Lender or financial institution shall for all purposes hereof constitute an Extending Lender.
